A bill to amend 1954 PA 116, entitled "Michigan election law," by amending section 163 (MCL 168.163), as amended by 1999 PA 218. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 163. (1)To obtain the printing ofEXCEPT AS PRO- 2 VIDED IN SUBSECTION (2), IN ORDER FOR the name of a person as a 3 candidate for nomination by a political party for the office of 4 state senator or STATE representative TO APPEAR under a particu- 5 lar party headinguponON the official primaryballots in the6various election precincts of a district, there shall be filed7nominating petitionsBALLOT, A NOMINATING PETITION SHALL BE 8 signed by a number of qualified and registered electors residing 9 in the district as determined under section 544f. If the 10 district comprises more than 1 county, the nominatingpetitions06946'00 CAS 2 1 PETITION shall be filed with the secretary of state. If the 2 districtcomprisesIS WITHIN 1 county,or less,the nominat- 3 ingpetitionsPETITION shall be filed with the county clerk of 4 that county. Nominating petitions shall be in the form pre- 5 scribed in section 544c. The NOMINATING PETITION SHALL BE FILED 6 WITH THE secretary of stateand the various county clerks shall7receive nominating petitions for filing in accordance with this8act up toOR COUNTY CLERK NO LATER THAN 4 p.m. of the twelfth 9 TuesdayprecedingBEFORE the August primary. 10 (2)In lieuINSTEAD of filing a nominating petition, THE 11 CANDIDATE MAY PAY a filing fee of $100.00may be paidto the 12 county clerk or, for a candidate in a district comprising more 13 than 1 county, to the secretary of state. Payment of the fee and 14 certification of the name of the candidate paying the feeshall15beARE governed by the same provisions asin the case ofFOR A 16 nominatingpetitionsPETITION. The fee shall be deposited in 17 the general fund of the county OR STATE and shall be refunded to 18 candidates who are nominated and to an equal number of candidates 19 who receive the next highest number of votes in the primary 20 election. If 2 or more candidates tie in having the lowest 21 number of votes allowing a refund, the sum of $100.00 shall be 22 divided among them.
