A bill to amend 1919 PA 71, entitled "An act to provide for the formulation and establishment of a uniform system of accounting and reporting in the several depart- ments, offices, and institutions of the state government, and in all county offices; to provide for the examination of the books and accounts of each state department, office, and institution, and of each county office; to provide for financial reports from all such departments, institutions, and offices, and for the tab- ulation and publication of comparative financial statistics relating thereto; to provide for the administration of this act; to provide for the powers and duties of the department of trea- sury, the auditor general, the library of Michigan and depository libraries, and other officers and entities; to provide penalties; and to provide for meeting the expense authorized by this act," (MCL 21.41 to 21.55) by adding section 6a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 6A. (1) THE AUDITOR GENERAL, DEPUTY AUDITOR GENERAL, 2 OR ANY PERSON DULY APPOINTED BY THE AUDITOR GENERAL, WHEN CON- 3 DUCTING AN AUDIT OR INVESTIGATION, HAS UNRESTRICTED ACCESS TO ALL 4 RECORDS AND INFORMATION RELATING TO ALL OPERATIONS OF THE 5 GOVERNMENTAL UNIT OR UNITS SUBJECT TO AUDIT OR INVESTIGATION. 06722'00 JLB 2 1 DISCLOSING INFORMATION TO THE AUDITOR GENERAL, DEPUTY AUDITOR 2 GENERAL, OR ANY PERSON DULY APPOINTED BY THE AUDITOR GENERAL 3 UNDER THIS SECTION DOES NOT ABROGATE OR WAIVE ANY PRIVILEGE OF 4 CONFIDENTIALITY, INCLUDING, BUT NOT LIMITED TO, THE 5 ATTORNEY-CLIENT PRIVILEGE, THAT MAY OTHERWISE BE LEGITIMATELY 6 ASSERTED TO SHIELD RECORDS FROM PUBLIC ACCESS. 7 (2) ANY GOVERNMENTAL UNIT THAT RECEIVES STATE OR FEDERAL 8 FUNDING UNDER A CONTRACT TO PROVIDE A SERVICE OR PRODUCT SHALL 9 PROVIDE THE AUDITOR GENERAL, DEPUTY AUDITOR GENERAL, OR ANY 10 PERSON DULY APPOINTED BY THE AUDITOR GENERAL WITH UNRESTRICTED 11 ACCESS TO ALL RECORDS AND INFORMATION RELATED TO THE PERFORMANCE 12 OF THE CONTRACT. 13 (3) AS USED IN THIS SECTION, "GOVERNMENTAL UNIT" MEANS THIS 14 STATE; ALL DEPARTMENTS, OFFICES, BOARDS, COMMISSIONS, AGENCIES, 15 AUTHORITIES, AND INSTITUTIONS OF THE EXECUTIVE, LEGISLATIVE, OR 16 JUDICIAL BRANCH OF THIS STATE ESTABLISHED BY THE STATE CONSTITU- 17 TION OF 1963 OR BY LAW; AND ALL COUNTY OFFICES. 06722'00 Final page.
