        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   by amending section 239 (MCL 750.239).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 239.  (1)  All pistols, weapons or devices  SUBJECT TO

 2
      SECTION 239A AND SUBSECTION (2), A PISTOL, WEAPON, OR DEVICE THAT

 3
      IS carried, possessed, or used  contrary to  IN VIOLATION OF this

 4
      chapter  are hereby declared  IS forfeited to the state  , 
   and

 5
      shall be turned over to the  commissioner  DIRECTOR of the

 6
       Michigan  DEPARTMENT OF state police or his OR HER designated

 7
      representative, for  such disposition  DISPOSAL as the

 8
       commissioner may prescribe  DIRECTOR PRESCRIBES.

           (2) THIS SECTION DOES NOT APPLY UNLESS THE PERSON WHO

10
      VIOLATES THIS CHAPTER IS CONVICTED OF THE VIOLATION.
