SENATE BILL NO. 23


   January 13, 1999, Introduced by Senator DUNASKISS and referred 
        to the Committee on Technology and Energy.



        A bill to amend 1909 PA 106, entitled

   "An act to regulate the transmission of electricity through the
   public highways, streets and places of this state, where the
   source of supply and place of use are in the same or different
   counties; to regulate the charges to be made for electricity so
   transmitted; to regulate the rules and conditions of service
   under which said electricity shall be furnished and to confer
   upon the Michigan public utilities commission certain powers and
   duties in regard thereto,"

   by amending sections 1 and 2 (MCL 460.551 and 460.552).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1.  When  IF electricity is generated or
             developed by

 2    steam, water, or other power, within 1 county of this state, and

 3    transmitted and delivered to  the  A consumer in
             the same or some

 4    other county, then the transmission and distribution of the

 5     same  ELECTRICITY in or on the public highways,
             streets, and

 6    places, the rate of charge  to be made to the consumer for
             the

 7     electricity so transmitted and distributed and the rules

 1    conditions of service under which  said  THE
             electricity  shall

 2     be  IS transmitted and distributed  shall
                       be  IS subject to regu-

 3    lation  as in  UNDER this act.  provided.
             

 4         Sec. 2.  The Michigan public  utilities 
             SERVICE commission

 5     , hereinafter referred to as "the commission" 
             shall  have  con-

 6    trol and  supervision of  SUPERVISE the business of
             transmitting

 7    and supplying electricity  as mentioned in the first section
             of

 8     this act and no  IN THIS STATE.  A public utility
                       supplying elec-

 9    tricity shall NOT put into force any rate or charge for the

10     same  ELECTRICITY without first petitioning
