SENATE BILL NO. 303


   February 16, 1999, Introduced by Senator YOUNG and referred to 
        the Committee on Government Operations.



        A bill to amend 1986 PA 268, entitled

   "Legislative council act,"

   by amending section 203 (MCL 4.1203).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 203.  (1) The Michigan register fund is created in the

 2    state treasury and shall be administered by the council.  The

 3    fund shall be expended only as provided in this section.

 4         (2) The money received from the sale of the Michigan regis-

 5    ter, along with those amounts paid by state agencies pursuant to

 6    section 57 of the administrative procedures act of 1969, 
             Act

 7     No. 306 of the Public Acts of 1969, being section 24.257 of
                       the

 8     Michigan Compiled Laws  1969 PA 306, MCL 24.257,
                       shall be depos-

 9    ited with the state treasurer and credited to the Michigan

10    register fund.

 1         (3) The Michigan register fund shall be used to pay the

 2    costs of preparing, printing, and distributing the Michigan

 3    register.

 4         (4) The department of management and budget shall sell

 5    copies of the Michigan register at a price determined by the

 6    bureau not to exceed the cost of preparation, printing, and

 7    distribution.

 8         (5) NOTWITHSTANDING SECTION 204, BEGINNING JANUARY 1, 2001,

 9    THE COUNCIL SHALL MAKE THE TEXT OF THE MICHIGAN REGISTER AVAIL-

10    ABLE TO THE PUBLIC ON THE INTERNET.

11         (6) THE INFORMATION DESCRIBED IN SUBSECTION (5) THAT IS

12    MAINTAINED BY THE COUNCIL SHALL BE MADE AVAILABLE IN THE SHORTEST

13    FEASIBLE TIME AFTER THE INFORMATION IS AVAILABLE.  THE INFORMA-

14    TION DESCRIBED IN SUBSECTION (5) THAT IS NOT MAINTAINED BY THE

15    COUNCIL SHALL BE MADE AVAILABLE IN THE SHORTEST FEASIBLE TIME

16    AFTER IT IS MADE AVAILABLE TO THE COUNCIL.

17         (7) SUBSECTION (5) DOES NOT ALTER OR RELINQUISH ANY COPY-

18    RIGHT OR OTHER PROPRIETARY INTEREST OR ENTITLEMENT OF THIS STATE

19    RELATING TO ANY OF THE INFORMATION MADE AVAILABLE UNDER SUBSEC-

20    TION (5).

21         (8) THE COUNCIL SHALL NOT CHARGE A FEE FOR PROVIDING THE

22    MICHIGAN REGISTER ON THE INTERNET AS PROVIDED IN SUBSECTION (5).

23         (9)  (5)  As used in this section, "Michigan
             register" means

24    that term as defined in section 5 of the administrative proce-

25    dures act of 1969,  Act No. 306 of the Public Acts of 1969,
             being

26     section 24.205 of the Michigan Compiled Laws  1969
                       PA 306, MCL
