A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1233 (MCL 380.1233), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1233. (1) Except as provided in this section and sec- 2 tion 1233b OTHERWISE PROVIDED BY LAW, the board of a school dis- 3 trict or intermediate school district shall not permit a teacher 4 who does not hold a valid teaching certificate to teach in a 5 grade or department of the school. , or a teacher without an 6 endorsement by the state board 7 (2) THE BOARD OF A SCHOOL DISTRICT OR INTERMEDIATE SCHOOL 8 DISTRICT SHALL NOT ALLOW AN INDIVIDUAL to serve in a counseling 9 role IN THE SCHOOL DISTRICT OR INTERMEDIATE SCHOOL DISTRICT, as 02502'99 TAV 2 1 the role is defined by the state boars, UNLESS THE INDIVIDUAL 2 MEETS 1 OR MORE OF THE FOLLOWING: 3 (A) THE INDIVIDUAL HOLDS A VALID TEACHING CERTIFICATE WITH A 4 COUNSELING ENDORSEMENT. 5 (B) THE INDIVIDUAL HOLDS AT LEAST A BACHELOR'S DEGREE AND 6 HAS AT LEAST 2 YEARS' EXPERIENCE AS A COUNSELOR IN THE PUBLIC OR 7 PRIVATE SECTOR. 8 (3) (2) The intermediate superintendent shall notify 9 immediately the state board IMMEDIATELY of the names of noncer- 10 tificated teachers teaching in violation of subsection (1) and 11 the names of nonendorsed teachers INDIVIDUALS serving in coun- 12 seling roles in violation of subsection (1) (2), the employing 13 district, and the amount of time the noncertificated and 14 nonendorsed teachers OR UNQUALIFIED INDIVIDUALS were employed. 15 (3) The board of a school district or intermediate school 16 district may renew through June 30, 1995 an annual vocational 17 authorization of a noncertificated vocational teacher who is 18 employed by the district or intermediate school district on June 19 1, 1987, even if a certificated teacher is available for hire, if 20 both of the following conditions are met: 21 (a) The noncertificated teacher is annually and continually 22 enrolled and completing credit in an approved vocational teacher 23 preparation program leading to vocational certification. 24 (b) The noncertificated teacher has a planned vocational 25 teacher preparation program leading to vocational certification 26 on file with the employing school district or intermediate school 02502'99 3 1 district, his or her teacher preparation institution, and the 2 department. 3 (4) A vocational teacher preparation institution shall uti- 4 lize the employment experience of an annually authorized teacher 5 for the purpose of waiving student teaching as a requirement for 6 vocational certification if the annually authorized teacher is 7 supervised by the teacher preparation institution. 8 (5) All vocational education teachers certified after 9 June 1, 1995 shall pass a competency test. 10 (6) The board of a school district or intermediate school 11 district may employ a person without a teaching certificate as a 12 substitute teacher if the person has at least 90 semester hours 13 of college credit from a college or university. 02502'99 Final page.
