SENATE BILL NO. 457


   March 23, 1999, Introduced by Senator STILLE and referred to the
        Committee on Local, Urban and State Affairs.



        A bill to authorize the department of natural resources to

   convey an easement across certain state owned property in

   Muskegon county; to prescribe conditions for the conveyance; and

   to provide for disposition of the revenue derived from the

   conveyance.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1.  The department of natural resources, on behalf of

 2    the state, shall convey to the charter township of Muskegon, in

 3    Muskegon county, for consideration as determined under section 2,

 4    a 66-foot roadway easement for the purpose of extending Becker

 5    road easterly from Sheridan drive in the charter township of

 6    Muskegon.  The easement is more particularly described as

 7    follows:

 1                                Parcel "A"

 2         The south 33.00 feet of the north one half of said Section

 3    2, Town 10 North, Range 16 West; except the east 1374.00 feet

 4    thereof.

 5                                Parcel "B"

 6         The north 33.00 feet of the south one half of said Section

 7    2, Town 10 North, Range 16 West; except the east 1374.00 feet

 8    thereof.

 9         Sec. 2.  The consideration paid by the charter township of

10    Muskegon for the easement shall be equal to the fair market value

11    of the property within the boundaries of the easement.  Fair

12    market value shall be as determined according to an assessment by

13    the state tax commission issued in 1999 and forwarded to the

14    charter township of Muskegon.

15         Sec. 3.  The conveyance authorized by this act shall be by

16    instrument prepared and approved by the attorney general.

17         Sec. 4.  The revenue received from the conveyance authorized

18    by this act shall be deposited in the state treasury and credited

19    to the general fund.
