A bill to amend 1979 PA 152, entitled "State license fee act," by amending sections 2, 6, and 38 (MCL 338.2202, 338.2206, and 338.2238), sections 2 and 6 as added by 1988 PA 461 and section 38 as added by 1990 PA 268. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. As used in this act: 2 (a) "Department" means the department of licensing and 3 regulation CONSUMER AND INDUSTRY SERVICES. 4 (b) "Occupational code" means Act No. 299 of the Public 5 Acts of 1980, being sections 339.101 to 339.2721 of the Michigan 6 Compiled Laws 1980 PA 299, MCL 339.101 TO 339.2721. 7 (c) "Public health code" means Act No. 368 of the Public 8 Acts of 1978, being sections 333.1101 to 333.25211 of the 9 Michigan Compiled Laws. 02548'99 a LBO 2 1 Sec. 6. The department shall charge a $20.00 late renewal 2 fee if a person fails to renew a license or registration on or 3 before the expiration date prescribed by the department by rule 4 as authorized under the occupational code. or the public health 5 code. 6 Sec. 38. (1) Fees for an individual licensed or seeking 7 licensure as a state licensed real estate appraiser, state cer- 8 tified general real estate appraiser, CERTIFIED RESIDENTIAL REAL 9 ESTATE APPRAISER, or a LIMITED real estate valuation specialist 10 APPRAISER under article 26 of the occupational code, being sec- 11 tions 339.2601 to 339.2635 of the Michigan Compiled Laws MCL 12 339.2601 TO 339.2637, are as follows: 13 (a) Application processing fees: 14 (i) State certified CERTIFIED GENERAL real estate 15 appraiser...................................... $25.00 16 (ii) CERTIFIED RESIDENTIAL REAL ESTATE APPRAISER.... $25.00 17 (iii) (ii) State licensed real estate appraiser... $25.00 18 (iv) (iii) Real LIMITED REAL estate valuation 19 specialist APPRAISER.......................... $25.00 20 (b) Examination fees, if the department conducts its own 21 examination: 22 (i) State certified CERTIFIED GENERAL real estate 23 appraiser...................................... $100.00 24 (ii) CERTIFIED RESIDENTIAL REAL ESTATE APPRAISER.... $100.00 25 (iii) (ii) State licensed real estate appraiser... $100.00 26 (c) License fee, per year: 02548'99 a 3 1 (i) State certified CERTIFIED GENERAL real estate 2 appraiser...................................... $175.00 3 (ii) CERTIFIED RESIDENTIAL REAL ESTATE APPRAISER.... $175.00 4 (iii) (ii) State licensed real estate appraiser... $175.00 5 (iv) (iii) Real LIMITED REAL estate valuation 6 specialist APPRAISER.......................... 175.00 7 $125.00 8 (D) TEMPORARY LICENSE FEE........................... $125.00 9 (2) The license fee includes a fee imposed by the federal 10 government under SECTIONS 1113 AND 1114 OF title XI of the finan- 11 cial institutions reform, recovery, and enforcement act of 1989, 12 Public Law 101-73, 12 U.S.C. 3331 to 3351, FOR CERTIFIED GENERAL 13 REAL ESTATE APPRAISERS, CERTIFIED RESIDENTIAL REAL ESTATE 14 APPRAISERS, AND STATE LICENSED REAL ESTATE APPRAISERS, which 15 shall not exceed $50.00 per licensee and which the department 16 shall collect and pay to the federal government pursuant to sec- 17 tion 2635 2637 of the occupational code, being section 18 339.2635 of the Michigan Compiled Laws MCL 339.2637. 19 (3) The real estate appraiser education fund is established 20 in the state treasury and shall be administered by the 21 department. Ten dollars of each fee received under subsection 22 (1)(c) shall be deposited with the state treasurer to the credit 23 of the real estate appraiser education fund. The department 24 shall utilize the real estate appraiser education fund only for 25 the operation of departmental programs related to the education 26 required of all licensees or applicants for licensure under 27 article 26 of the occupational code. Any unexpended balance in 02548'99 a 4 1 the real estate appraiser education fund at the end of a fiscal 2 year shall carry forward to the next fiscal year. 3 Enacting section 1.
