SENATE BILL NO. 578 May 6, 1999, Introduced by Senators MC MANUS, GAST and GOSCHKA and referred to the Committee on Farming, Agribusiness and Food Systems. A bill to amend 1988 PA 466, entitled "Animal industry act of 1987," by amending section 3 (MCL 287.703), as amended by 1998 PA 552. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) "Accredited veterinarian" means a veterinarian 2 approved by the United States department of agriculture to per- 3 form specific functions required by cooperative state-federal 4 disease control and eradication programs. 5 (2) "Animal" means mollusks, crustaceans, and vertebrates 6 other than human beings. 7 (3) "Aquaculture" means the commercial husbandry of aquacul- 8 ture species on the approved list of aquaculture species under 9 the Michigan aquaculture development act, 1996 PA 199, MCL 10 286.871 TO 286.884, including, but not limited to, the culturing, 11 producing, growing, using, propagating, harvesting, transporting, 02784'99 b LBO 2 1 importing, exporting, or marketing of any products, coproducts, 2 or by-products of fish, crustaceans, mollusks, reptiles, and 3 amphibians, reared or cultured under controlled conditions in an 4 aquaculture facility. 5 (4) "Aquaculture facility" means a farm or farm operation 6 engaged in any aspect of aquaculture in privately controlled 7 waters capable of holding all life stages of aquacultural species 8 with a barrier or enclosure designed to prevent their escape into 9 waters of the state. An aquaculture facility does not include 10 any facility not regulated under the Michigan aquaculture devel- 11 opment act, 1996 PA 199, MCL 286.871 TO 286.884. 12 (5) "Approved vaccine" means a veterinary biological admin- 13 istered to livestock or other animals to induce immunity in the 14 recipient. The use of the approved vaccine in this state shall 15 be approved by the state veterinarian. 16 (6) "Captive cervidae" means members of the cervidae family 17 including, but not limited to, deer, elk, moose, and caribou 18 living under the husbandry of humans. CAPTIVE CERVIDAE INCLUDES 19 FARMED CERVIDAE AS THAT TERM IS DEFINED IN THE MICHIGAN FARMED 20 CERVIDAE DEVELOPMENT ACT. 21 (7) "Captive cervidae ranch" means any premises that con- 22 tains 1 or more captive white-tailed deer or captive elk and has 23 captive white-tailed deer or captive elk removed by the hunting 24 method. 25 (8) "Captive elk farm" means any premises that contains 1 or 26 more captive elk and does not have any captive elk removed by the 27 hunting method. 02784'99 b 3 1 (9) "Captive white-tailed deer farm" means any premises that 2 contains 1 or more captive white-tailed deer and does not have 3 any captive white-tailed deer removed by the hunting method. 4 (10) "Carcasses" means the dead bodies of animals, poultry, 5 or fish. Carcasses do not include rendered products. 6 (11) "Cattle" means all bovine (genus bos) animals, bovine- 7 like animals (genus bison) also commonly referred to as American 8 buffalo or bison and any cross of these species unless otherwise 9 specifically provided. 10 (12) "Cattle importation lot" means a premises registered 11 with the department and used only to feed cattle in preparation 12 for slaughter. 13 (13) "Commingling" means concurrently or subsequently shar- 14 ing or subsequent use by native livestock of the same pen or same 15 section in a facility or same section in a transportation unit 16 where there is physical contact or contact with bodily excrements 17 or fluids from other livestock. 18 (14) "Consignee" means the person within the state of 19 Michigan receiving the animals at the point of destination named 20 on the official interstate health certificate, official inter- 21 state certificate of veterinary inspection, owner-shipper state- 22 ment, or sales invoice. 23 (15) "Contagious disease" means an illness due to a specific 24 infectious agent or suspected infectious agent or its toxic pro- 25 ducts which arises through transmission of that agent or its pro- 26 ducts from an infected animal, or inanimate reservoir to a 27 susceptible host, either directly or indirectly through an 02784'99 b 4 1 intermediate plant or animal host, vector, or the inanimate 2 environment, or via an airborne mechanism. 3 (16) "Department" means the department of agriculture. 4 (17) "Direct movement" means transfer of animals to a desti- 5 nation without unloading the animals en route and without expo- 6 sure to any other animals or bodily excrements or fluids from 7 other animals. 8 (18) "Director" means the director of the department of 9 agriculture or his or her authorized representative. 10 (19) "Disease" means any animal health issue with economic 11 impacts in terms of restricted movement or markets, whether due 12 to residues, metabolic problems, public health concerns, multiple 13 causes, or food safety issues. 14 (20) "Distribute" means to deliver other than by administer- 15 ing or dispensing a veterinary biological. 16 (21) "Domestic animal" means those species of animals indig- 17 enous to North America which have lived under the husbandry of 18 humans. 19 (22) "Emergency fish diseases" means certain infectious dis- 20 eases of fish that are transmissible directly or indirectly from 21 1 fish to another and are not known to exist within the waters of 22 the state. Emergency fish diseases include, but are not limited 23 to, viral hemorrhagic septicemia, infectious hematopoietic necro- 24 sis, ceratomyxosis, and proliferative kidney disease. 25 (23) "Equine" means all animals of the equine family which 26 includes horses, asses, jacks, jennies, hinnies, mules, donkeys, 27 burros, ponies, and zebras. 02784'99 b 5 1 (24) "Exhibition or exposition" means a congregation, 2 gathering, or collection of livestock that are presented or 3 exposed to public view for show, display, swap, exchange, enter- 4 tainment, educational event, instruction, advertising, or 5 competition. Exhibition or exposition does not include livestock 6 for sale at public stockyards, auctions, saleyards, and livestock 7 yards licensed under the provisions of 1937 PA 284, MCL 287.121 8 to 287.131. 9 (25) "Exhibition facility" means any facility used or 10 intended to be used for public view, show, display, swap, 11 exchange, entertainment, advertisement, educational event, or 12 competition involving livestock. Exhibition facility does not 13 include a public stockyard, an auction saleyard, and a livestock 14 yard where livestock are accepted on consignment and the auction 15 method is used in the marketing of the livestock. 16 (26) "Exhibitor" means any person who presents livestock for 17 public display, exhibition, or competition or enters livestock in 18 a fair, show, exhibition, or exposition. 19 (27) "Exotic animal" means those animals that are not domes- 20 tic or any cross of those animals not domestic to North America. 21 (28) "Fair" means a competition and educational exhibition 22 of agricultural commodities and manufactured products for which 23 premiums may be paid and which is conducted by an association or 24 governmental entity. 25 (29) "Feral swine" means swine which have lived their life 26 or any part of their life as free roaming or not under the 27 husbandry of humans. 02784'99 b 6 1 Enacting section 1.
