A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 1e of chapter IV (MCL 764.1e), as added by 1980 PA 506. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 CHAPTER IV 2 Sec. 1e. (1) For purposes of sections 1a to 1d of this 3 chapter, a complaint signed by a peace officer shall be treated 4 as made under oath if the offense alleged in the complaint is a 5 minor offense which was committed in the signing officer's 6 presence or was committed under circumstances permitting the 7 officer's issuance of a citation under section 625 or 728(8) of 8 Act No. 300 of the Public Acts of 1949, as amended, being 9 sections 257.625 and 257.728 of the Michigan Compiled Laws, THE 10 MICHIGAN VEHICLE CODE, 1949 PA 300, MCL 257.625 AND 257.728, OR 02678'99 b TLG 2 1 UNDER SECTION 80180 OF THE NATURAL RESOURCES AND ENVIRONMENTAL 2 PROTECTION ACT, 1994 PA 451, MCL 324.80180, and if the complaint 3 contains the following statement immediately above the date and 4 signature of the officer: 5 "I declare under the penalties of perjury that the state- 6 ments above are true to the best of my information, knowledge, 7 and belief.". 8 (2) A peace officer who, knowing the statement is false, 9 makes a materially false statement in a complaint signed pursuant 10 to subsection (1) is guilty EACH OF THE FOLLOWING: 11 (A) GUILTY of perjury, a felony punishable by imprisonment 12 for not more than 15 years. , and in addition, is in 13 (B) IN contempt of court. 14 Enacting section 1. This amendatory act takes effect 15 April 1, 2000. 16 Enacting section 2.
