SENATE BILL No. 806 October 14, 1999, Introduced by Senators HOFFMAN, KOIVISTO, GAST, MC COTTER, GOSCHKA, STILLE, HAMMERSTROM and BULLARD and referred to the Committee on Local, Urban and State Affairs. A bill to authorize a county, city, village, or township law enforcement agency to enter into mutual aid agreements with law enforcement agencies of a physically adjacent state; to prescribe the minimum terms of the mutual aid agreements; and to provide immunity from civil and criminal actions to certain persons. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Agreement" means a written agreement between 1 or more 3 law enforcement agencies in this state and at least 1 law 4 enforcement agency in a physically adjacent state. 5 (b) "Law enforcement agency" means a police or sheriff's 6 department that has the authority to enforce the general criminal 7 laws of this state or a similar governmental organization of a 8 physically adjacent state. 00087'99 JJG 2 1 Sec. 2. Subject to section 3, a county, city, village, or 2 township law enforcement agency of this state may enter into a 3 mutual aid agreement with a law enforcement agency of a physi- 4 cally adjacent state. 5 Sec. 3. An agreement entered into under this act shall 6 first be authorized by the governing body of the law enforcement 7 agency of this state and the governing body of the law enforce- 8 ment agency of the physically adjacent state and shall include at 9 least all of the following terms: 10 (a) The name and title of the official who may initiate a 11 mutual aid request and a mutual aid response under the 12 agreement. 13 (b) The nature of an emergency situation that may initiate a 14 request or a response of the law enforcement agency to or from 15 the law enforcement agency of the physically adjacent state. 16 (c) The arrest authority of the law enforcement officers 17 responding from the law enforcement agency of the physically 18 adjacent state. 19 (d) The chain of command for the supervision of the respond- 20 ing law enforcement officers from the law enforcement agency of 21 the physically adjacent state. 22 Sec. 4. A law enforcement officer from a physically adja- 23 cent state, who responds under the terms of an agreement entered 24 into under this act, has the same authority and immunity from 25 criminal and civil liability as a law enforcement or police offi- 26 cer of this state. 00087'99 Final page.
