SENATE BILL No. 823 October 19, 1999, Introduced by Senator JAYE and referred to the Committee on Hunting, Fishing and Forestry. A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending sections 227, 227c, and 227d (MCL 750.227, 750.227c, and 750.227d), section 227 as amended by 1986 PA 8 and sections 227c and 227d as added by 1981 PA 103. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 227. (1) A person shall not carry a dagger, dirk, OR 2 stiletto, a double-edged nonfolding stabbing instrument of any 3 length, or any other dangerous weapon, except a hunting knife 4 adapted and carried assuchA HUNTING KNIFE, concealed on or 5 about his or her person,or, whether concealed or otherwise, 6 inanyA vehicle operated or occupied by the person, except in 7 his or her dwelling house,OR place of business or on other 8 land possessed by the person. 04208'99 JJG 2 1 (2) A person shall not carry a pistol concealed on or about 2 his or her person,or, whether concealed or otherwise, in a 3 vehicle operated or occupied by the person, except in his or her 4 dwelling house,OR place of business,or on other land pos- 5 sessed by the person, without a license to carry the pistol as 6 provided by law and, if licensed, shall not carry the pistol in a 7 place or manner inconsistent with any restrictions uponsuch8 THE license. 9 (3) THIS SECTION DOES NOT PROHIBIT A PERSON FROM CARRYING A 10 PISTOL IN A VEHICLE IN COMPLIANCE WITH SECTION 227D. 11 (4)(3)A person who violates this section is guilty of a 12 felony,punishable by imprisonment for not more than 5 years 13,orbya fine of not more than $2,500.00, OR BOTH. 14 Sec. 227c. (1) Except as otherwise permitted by law, a 15 person shall not transport or possess A LOADED FIREARM in or upon 16 asail boat or amotor vehicle, aircraft, SAILBOAT OR motor- 17 boat, or any other vehicle propelled by mechanical means., a18firearm, other than a pistol, which is loaded.19 (2) A person who violates this section is guilty of a misde- 20 meanor,punishable by imprisonment for not more than 2 years 21,or a fine of not more than $2,500.00, or both. 22(3) This section does not apply to a person who violates23section 10(1)(g) of chapter II of Act No. 286 of the Public Acts24of 1929, as amended, being section 312.10 of the Michigan25Compiled Laws.26 Sec. 227d. (1) Except as otherwise permitted by law, a 27 person shall not transport or possess A FIREARM in or upon a 04208'99 3 1 motor vehicle or any self-propelled vehicle designed for land 2 travela firearm, other than a pistol,unless the firearm is 3 unloaded and is 1 or more of the following: 4 (a) Taken down. 5 (b) Enclosed in a case. 6 (c) Carried in the trunk of the vehicle. 7 (d) Inaccessible from the interior of the vehicle. 8 (2) A person who violates this section is guilty of a misde- 9 meanor,punishable by imprisonment for not more than 90 days 10,or a fine of not more than $100.00, or both. 11 Enacting section 1.
