A bill to amend 1935 PA 140, entitled
"An act to prohibit endurance contests known as walkathons and
similar endurance contests; to prescribe a penalty for the viola-
tion thereof, and to repeal Act No. 65 of the Public Acts of
1933,"
by amending sections 1 and 2 (MCL 752.161 and 752.162).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) It shall be
unlawful for any EXCEPT AS PRO-
2 VIDED IN SUBSECTION (2), A
person , firm, or corporation to
3 SHALL NOT promote, conduct, or participate in any endurance con-
4 test known as a walkathon or similar endurance contest.
5 (2) SUBSECTION (1) DOES NOT APPLY TO AN EVENT THAT BEGINS
6 AND ENDS ON THE SAME DAY OR AN EVENT THAT IS COMPLETED WITHIN A
7 PREDETERMINED TIME PERIOD OF LESS THAN 12 HOURS.

1 (3) AS USED IN THIS ACT, "PERSON" MEANS AN INDIVIDUAL,
2 PARTNERSHIP, CORPORATION, ASSOCIATION, GOVERNMENTAL ENTITY, OR
3 OTHER LEGAL ENTITY.
4 Sec. 2. Any
A person , firm or corporation violating the
5 provisions of
WHO VIOLATES this act shall be deemed IS
guilty
6 of a misdemeanor , and
upon conviction thereof shall be punish-
7 able by a fine of not more than
100 dollars $100.00 or impris-
8 onment in the county jail
for not more than 90 days, or both.

imprisonment, in the discretion of the court.
10 Each violation shall
constitute CONSTITUTES a separate and dis-
11 tinct offense.
