A bill to amend 1980 PA 299, entitled
"Occupational code,"
by amending section 1805 (MCL 339.1805).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1805. (1) A person licensed under this article may
2 disinfect or preserve a dead human body, entirely or in part, by
3 the use of a chemical substance,
fluid,
or gas in the body of
4 OR by the introduction of a chemical, substance, fluid, or gas
5 into the body by a vascular or
hypodermic injection , or by
6 direct application into an organ or cavity in preparation for
7 burial or disposal. The person may direct the burial or disposal
8 of a dead human body and may maintain a funeral establishment for
9 the preparation and disposition
, or
for the care of a dead
10 human body. and

1 (2) A PERSON LICENSED UNDER THIS ARTICLE WHO DISPOSES A DEAD
2 HUMAN BODY BY MEANS OF CREMATION IS IMMUNE FROM CIVIL LIABILITY
3 FOR DISPOSING OF ANY ASHES REPRESENTING THE REMAINS OF THE DEAD
4 HUMAN BODY 5 YEARS OR LONGER AFTER THE DATE OF CREMATION OR AT
5 ANY OTHER TIME INTERVAL SPECIFICALLY ESTABLISHED IN THE CONTRACT
6 OR AGREEMENT FOR DISPOSITION. AS USED IN THIS SUBSECTION,
7 "CREMATION" MEANS THAT TERM AS DEFINED IN SECTION 2 OF THE CEME-
8 TERY REGULATION ACT, 1968 PA 251, MCL 456.522.
9 (3) A PERSON LICENSED UNDER THIS ARTICLE may, in connection
10 with the person's name or the name of the funeral establishment,
11 use the words "funeral director", "undertaker", "mortician", OR
12 "mortuary science" ,
or a word of
similar meaning as approved
13 by the department.
