AN ACT to make, supplement, and adjust appropriations for capital outlay and various state departments and agencies for the fiscal year ending September 30, 1999; to implement the appropriations within the budgetary process; to provide for the expenditure of appropriations; and to repeal acts and parts of acts.

PART 2
PROVISIONS CONCERNING APPROPRIATIONS
GENERAL SECTIONS
Sec. 201. (1) Pursuant to section 30 of article IX of the state constitution of 1963, total state spending under part 1 for fiscal year 1998-1999 is $152,383,000.00 and state appropriations to be paid to local units of government are as follows:
ENVIRONMENTAL QUALITY
Waterfront redevelopment grant program $ 20,000,000
Brownfield grants and loans program 2,000,000
NPL-municipal landfill match grants program 2,000,000

(2) If it appears to the principal executive officer of a department or branch that state spending to local units of government will be less than the amount that was projected to be expended under subsection (1), the principal executive officer shall immediately give notice of the approximate shortfall to the state budget director.
Sec. 202. The expenditures and funding sources authorized under this bill are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.
CAPITAL OUTLAY
Sec. 301. The $3,300,000.00 in resources appropriated in section 102 for recreation bond projects represent a portion of the final projected balance of 1988 recreation bond fund resources and is designated for state park projects. This amount shall be used to supplement the funding provided from the clean Michigan initiative and shall be used in the manner prescribed for the respective programs in 1998 PA 286, MCL 324.71601 to 324.71607, and 1998 PA 288, MCL 324.19601 to 324.19616.
ENVIRONMENTAL QUALITY
Sec. 401. (1) In addition to the funds appropriated in part 1 for environmental cleanup and redevelopment, leaking underground storage tank cleanup, and the contaminated lake and river sediments cleanup programs, the department of environmental quality is authorized to expend amounts remaining from prior fiscal year appropriations to meet funding needs of legislatively approved sites.
(2) Unexpended and unencumbered amounts remaining from appropriations from the environmental protection bond fund contained in 1989 PA 180, 1990 PA 55, 1990 PA 194, 1991 PA 31, 1991 PA 160, 1993 PA 74, 1993 PA 353, 1994 PA 442, 1996 PA 353, and 1997 PA 114 are appropriated for expenditure for any site listed in this bill and any site listed in the public acts referenced under this section.
(3) Unexpended and unencumbered amounts remaining from appropriations from the cleanup and redevelopment fund and unclaimed bottle deposits fund contained in 1996 PA 319, 1997 PA 113, 1997 PA 114, and 1998 PA 292 are appropriated for expenditure for any site listed in this bill and any site listed in the public acts referenced under this section.
(4) Unexpended and unencumbered amounts remaining from appropriations from the clean Michigan initiative fund - response activities fund are appropriated for expenditure for any site listed in this bill and any site listed in the public acts referenced under this section.
Sec. 402. (1) The department shall report all of the following information relative to allocations in part 1 for the environmental cleanup and redevelopment program, state cleanup, emergency actions, superfund cleanup, and revitalization revolving loan fund, the brownfield grants and loans program, the NPL-municipal landfill match grants program, the waterfront redevelopment grant program, the leaking underground storage tank cleanup program, the contaminated lake and river sediments cleanup program, the nonpoint source pollution prevention and control projects program, and the environmental projects under section 19508(7) of the natural resources and environmental protection act, 1994 PA 451, MCL 324.19508, to the state budget director, the senate and house of representatives appropriations subcommittees on environmental quality, and the senate and house fiscal agencies:
(a) The name and location of the site for which an allocation is made.
(b) The nature of the problem encountered at the site.
(c) A brief description of how the problem will be resolved if the allocation is made for a response activity.
(d) The estimated time to complete the activities for project closure.
(e) The amount of the allocation, or the anticipated financing for the site.
(f) A summary of the sites and the total amount of funds expended at the sites at the conclusion of the fiscal year.
(g) The number of sites that would qualify as brownfields that were redeveloped.
(2) The report shall be made available by March 31 of each year.
Sec. 403. The unexpended portions of the appropriation in part 1 for the department of environmental quality listed in this section are considered work project appropriations. The purpose of these projects is to provide redevelopment and contaminated site cleanup and pollution prevention control to be accomplished through contractual services with estimated completion dates of September 30, 2003. The projects are as follows:
(a) Environmental cleanup and redevelopment program (estimated cost $47,856,000.00).
(b) Waterfront redevelopment grant program (estimated cost $20,000,000.00).
(c) Leaking underground storage tank cleanup program (estimated cost $12,597,000.00).
(d) Contaminated lake and river sediments cleanup program (estimated cost $4,300,000.00).
(e) Nonpoint source pollution prevention and control projects program (estimated cost $12,000,000.00).
(f) Small business pollution prevention loans (estimated cost $5,000,000.00).
(g) Brownfield grants and loans program (estimated cost $10,000,000.00).
(h) NPL-municipal landfill match grants program (estimated cost $2,000,000.00).
Sec. 404. From the appropriation in part 1 for the program under part 196 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.19601 to 324.19616, clean Michigan initiative fund program, the department shall continue to make authorizations for response activities at brownfield redevelopment and environmental cleanup sites and for the administration of the program created by part 196 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.19601 to 324.19616.
Sec. 405. The funds appropriated in section 103 for the environmental cleanup and redevelopment program shall be used to fund redevelopment and cleanup activities on the following sites:

Sec. 407. The funds appropriated in section 103 for contaminated lake and river sediments cleanup program shall be used to fund cleanup activities on the following sites:
Gratiot - Pine River
Montcalm - Unnamed Tributary to Wolf Creek
Muskegon - Muskegon Lake-Ruddiman Creek
Muskegon - Whitehall Leather (White Lake - Tannery Bay)
Wayne - Detroit River - Black Lagoon
Sec. 408. The funds appropriated in section 103 for the retired engineers technical assistance fund shall capitalize the retired engineers technical assistance fund under section 14512 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.14512.
Sec. 409. The funds appropriated in section 103 for the small business pollution prevention assistance revolving loan fund shall capitalize the small business pollution prevention assistance revolving loan fund under section 14513 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.14513.
Sec. 410. The funds appropriated in section 103 for the small business pollution prevention assistance program shall be expended by the department to provide loans to small businesses to implement pollution prevention recommendations made in audits conducted under the retired engineers technical assistance program and for other qualifying pollution prevention expenditures defined under section 14513(6)(b) of the natural resources and environmental protection act, 1994 PA 451, MCL 324.14513.
Sec. 411. The department shall not expend funds pursuant to section 19608(1)(f)(iii) of the natural resources and environmental protection act, 1994 PA 451, MCL 324.19608, for lawn mower or outboard motor buyback programs until the department provides the house and senate appropriations committees a comparison of costs and benefits of such programs relative to voluntary programs to reduce emissions from municipal and industrial facilities.
MISCELLANEOUS
Sec. 501. Sections 223 and 1006 of 1998 PA 292 are repealed.
This act is ordered to take immediate effect.
