AN ACT to amend 1949 PA 300, entitled "An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of owners and operators of vehicles and service of process on residents and nonresidents; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date," (MCL 257.1 to 257.923) by adding section 811k.

The People of the State of Michigan enact:

Sec. 811k. (1) The secretary of state shall develop under section 811e and, upon application, may issue under section 811f a state-sponsored lighthouse fund-raising registration plate and a matching state-sponsored lighthouse fund-raising collector plate as provided under section 811g. The plate shall be of a design as determined by the secretary of state.

(2) The Michigan lighthouse preservation grant fund is created as a separate fund in the department of treasury. The fund shall be expended only as provided in this section. The state treasurer may receive money or other assets from any source for deposit into the fund. The state treasurer shall direct the investment of the fund. The state treasurer shall credit to the fund interest and earnings from fund investments. The state treasurer shall annually present to the secretary of state an accounting of the amount of money in the fund. Money in the fund at the close of the fiscal year shall remain in the fund and shall not lapse to the general fund.

(3) The secretary of state shall administer the fund and may expend money from the fund through discretionary historical grants to preserve Michigan lighthouses. The secretary of state shall not use not more than 10% of the funds for the secretary of state's costs that occur from fund administration and grant project coordination.

(4) The secretary of state may award grants for the preparation of plans and specifications for restoration and stabilization and for stabilization, rehabilitation, or other preservation work on a Michigan lighthouse, but grants shall not be awarded for operational purposes. The secretary of state shall allocate grant funds pursuant to eligibility and scoring requirements established by the secretary of state. To award grants under this section, the secretary of state shall solicit applications from eligible recipients, score applications based on the established criteria, and award grants through executed contracts. All plans and work performed under a grant shall be consistent with the United States secretary of the interior's standards for rehabilitation and guidelines for rehabilitating historic buildings, 36 C.F.R. 67, historic preservation certifications.

(5) Lighthouse fund-raising registration plate donations collected under section 811f and matching lighthouse collector plate fund-raising donations collected under section 811g shall be transferred under section 811m by the secretary of state to the state treasurer, who shall credit the donation money to the Michigan lighthouse preservation grant fund for the preservation of historic Michigan lighthouses.

(6) For purposes of this chapter, "state-sponsored lighthouse fund-raising registration plate" means a registration plate containing a specialized design pertaining to historic Michigan lighthouses.

Enacting section 1. This amendatory act takes effect October 1, 2000.

Enacting section 2. This amendatory act does not take effect unless Senate Bill No. 826 of the 90th Legislature is enacted into law.
