ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SENATE BILLS 781 AND 782 DATED 12-6-01:

HOUSE COMMITTEE ACTION:

The House Committee on Health Policy adopted a substitute bill for Senate Bill 781 to allow a physician to give to a patient with reduced life expectancy due to advanced illness (or the patient's surrogate or advocate) a copy of the current standardized, written summary before July 1, 2002 and a copy of the new summary or after July 1, 2002. Giving a patient a copy of the current summary or the new summary, before or on or after July 1, 2002 would count as the physician's full compliance with certain requirements dealing with information that must be provided both orally and in writing. These requirements are specified in sections of the Michigan Dignified Death Act that would be amended by both Senate Bill 782, as passed by the Senate, and House Bill 5258, as passed by the House. The Senate-passed version of the bill is tie-barred to Senate Bill 782, but the House substitute is tie-barred to House Bill 5258 instead. Finally, the House substitute would change the effective date of the act from March 1, 2002 to October 1, 2002.
