ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SB 1437 DATED 11-4-02:

HOUSE COMMITTEE ACTION:

The House Committee on Commerce adopted one amendment to the Senate-passed version of Senate Bill 1438. Senate Bill 1437 was reported from committee without amendment. The amendment to Senate Bill 1438 amended the portion of the bill that addresses how continuing education requirements are to be met over the new three-year licensure period.

In its current form Senate Bill 1438 would require, as of November 1, 2003, that a licensee complete at least 18 hours of continuing education over the three-year license cycle. At least six hours would have to be completed during the time period from November 1, 2003 and ending December 31, 2004. During calendar year 2005, a licensee would have to complete at least six hours. During calendar year 2006, a licensee would have to complete four hours, and for calendar year 2007 and thereafter, a licensee would have to complete at least two hours per calendar year. At least two hours per calendar year would have to involve law, rules, and court cases regarding real estate. However, the department could relicense a licensee who had completed the minimum 18 hours during the three-year cycle but who had not otherwise met the education requirements if the licensee provided satisfactory evidence to the department that he or she had good cause for not complying.

The bill also would specify that for real estate brokers, associate brokers, and salespersons who received a license issued in the second or third year of a license cycle, continuing education requirements would be as above except that 1) a broker, associate broker, or salesperson receiving a license in the second year would have to complete 12 hours to renew the license and if receiving a license in the third year, would have to complete 6 clock hours of continuing education.
