A SUMMARY OF HOUSE BILL 4095 AS INTRODUCED 1-31-01

Part 31 of the Natural Resources and Environmental Protection Act (NREPA), which concerns water resources protection, specifies that if untreated or partially treated sewage is discharged onto land or into the state's water, the responsible municipality must immediately contact other municipalities whose jurisdictions contain waters that may be affected by the discharge. In addition, the Department of Environmental Quality (DEQ), local health departments, and daily newspapers must immediately be notified of the circumstances of the discharge, including the amount, reason, beginning and ending times, and verification of the municipality's compliance with the requirements of its National Pollutant Discharge Elimination System (NPDES) permit. House Bill 4095 would require that, in addition, a responsible municipality would have to provide all of these entities with an annual report that summarized the information reported to the DEQ, local health departments, and daily newspapers during the previous calendar year. The report would have to be provided by February 1.
