BAN SMOKING IN RESTAURANTS

House Bill 4114

Sponsor: Rep. Raymond Basham

Committee: Regulatory Reform

Complete to 4-12-01

A SUMMARY OF HOUSE BILL 4114 AS INTRODUCED 1-31-01

The bill would amend the Public Health Code to ban smoking in the public areas of restaurants and other food service establishments. "Public area" would be defined as all areas of a food service establishment that are open to the public. The ban on smoking would not extend to an establishment that was owned and operated by a private club and that served only club members and their guests. The current exemption for establishments owned and operated by fraternal organizations would remain in place, as would the current exemptions for private facilities serviced by catering kitchens and separate rooms in food service establishments used for private banquets.
