A SUMMARY OF HOUSE BILL 4207 AS INTRODUCED 2-13-01

The bill would amend sections of the Penal Code (MCL 750.81 and 750.81a) which prescribe the penalties for various domestic assault offenses, to increase the penalties for certain domestic violence crimes, as follows:

ˇSimple assault-domestic (first offense) is currently a misdemeanor punishable by up to 93 days in prison, a fine of up to $500, or both. Under the bill, the penalty would be increased to one year in prison, a fine of up to $500, or both.

ˇSimple assault-domestic with one previous conviction may currently be punished by up to one year in prison, a fine of up to $1,000, or both. Under the bill, the offense would be a felony, punishable by two years in prison,

ˇSimple assault-domestic with two or more previous convictions is a felony punishable by up to two years in prison, a fine of up to $2,500, or both. Under the bill, the penalty would be increased to three years in prison, a fine of up to $2,500, or both.

ˇAggravated assault-domestic (first offense) is a misdemeanor, punishable by up to one year in prison, a fine of up to $1,000, or both. Under the bill, the offense would be a felony, punishable by two years in prison, a fine of up to $1,000, or both.

ˇAggravated assault-domestic with one or more previous convictions is a felony, punishable by up to two years in prison, a fine of up to $2,500, or both. Under the bill, the penalty would be increased to three years in prison, a fine of up to $2,500, or both.
