A SUMMARY OF HOUSE BILL 4218 AS INTRODUCED 2-13-01

Currently, the Revised Judicature Act (RJA) specifies that sheriffs and other officers serving any processes or papers are entitled to "traveling fees" from the county seat to the place of service plus a schedule of fees specified in the RJA. More specifically, the RJA allows varying fees (ranging from $2 for receiving and filing a bond from or on behalf of a defendant in a case of claim and delivery, to $27 plus "actual and reasonable expenses" in certain other cases, to a percentage of the receipts in the case of sale on levy in cases of "execution") plus mileage for service of process. The bill would specify that, in each of the fifteen instances of fees and mileage listed in the RJA, mileage would be for a maximum of three round trips.
