A SUMMARY OF HOUSE BILL 4401 AS INTRODUCED 3-6-01

The bill would amend the Code of Criminal Procedure to expand and clarify a local police officer's authority to make arrests outside of his or her jurisdiction. The bill would specify that a county, city, village, or township peace officer would be authorized to exercise authority outside the limits of his or her employing municipality in any of the following circumstances:

· while enforcing state laws in conjunction with the Michigan State Police;

· while enforcing state laws in conjunction with a peace officer of any local municipality in which he or she may be; or,

· when the officer has pursued an individual, for a violation of a state law or local ordinance that occurred in the officer's employing jurisdiction, to a place outside the officer's employing jurisdiction and he or she was enforcing that law or ordinance or any other law or ordinance that was violated during or after the pursuit.
