A SUMMARY OF HOUSE BILL 4549 AS INTRODUCED 3-29-01

The Michigan Penal Code imposes a mandatory sentence on persons who carry or possess a firearm at the time they commit or attempt to commit a felony (unless the felony itself is that of carrying a concealed weapon). This mandatory term of imprisonment cannot be suspended, and must be served prior to any sentence imposed for the conviction of the associated felony. Further, a person sentenced under this provision is not eligible for parole or probation during the mandatory term of imprisonment.

House Bill 4549 would increase the mandatory prison sentences under this provision. For a first conviction, the sentence would be increased from two to five years. For a second conviction, the sentence would be increased from five to ten years, and for a third or subsequent conviction, from ten to fifteen years.
