A SUMMARY OF HOUSE BILL 4643 AS INTRODUCED 4-24-01

The bill would add a new section to the Worker's Disability Compensation Act to allow claimants to request, and require employers and others to furnish, information relating to that claim.

More specifically, the bill would allow someone who made a claim under the act to submit a written request to an employer, insurance carrier, principal, or subcontractor for information relating to that claim that was in the latter's possession; and to require employers, carriers, principals, or subcontractors to provide, within 30 days after receiving the request, either the requested information to the person or else a written statement specifying that they did not have the information. (The bill would define "information" as including, but not limited to, data, reports, and records relating to an incident or injury that underlay a claim.)

An employer, carrier, principal, or subcontractor who violated the bill would pay to the person requesting the information $50 per day for each day after the 30-day deadline that information or a statement required under the bill was not provided.
