A SUMMARY OF HOUSE BILL 5065 AS INTRODUCED 9-10-01
Public Act 246 of 1931 provides for the construction and maintenance of sidewalks along public highways. The bill would add a provision to the act to specify that a township would not be liable for damages for injury to an individual's person or property sustained as a result of snow or ice on -- or the removal of snow or ice from -- a township street, sidewalk, crosswalk, or public highway, unless the individual served a notice in writing on the township clerk within 120 days after the injury occurred. Under the bill, the notice would have to state substantially the time when, and place where, the injury occurred, as well as the manner in which it occurred, the known extent of the injury, and that the individual sustaining the injury intended to hold the township liable for damages resulting from the injury.
