A SUMMARY OF HOUSE BILL 5184 AS INTRODUCED 10-10-01

Under the Natural Resources and Environmental Protection Act, the Department of Environmental Quality may revoke or deny a permit issued under the air pollution control provisions of the act under certain circumstances, and after giving notice and providing an opportunity for a public hearing. The bill would amend this part of the NREPA to allow the department to revoke a permit if, within the five-year period preceding the notification to the permit holder, there were continuous or repeated significant violations of the air pollution provisions of the act, their corresponding rules, or of the permit or an order issued under the act, unless the 'source' [of emissions] had been in compliance with a legally enforceable schedule of compliance contained in a permit or order.
