A SUMMARY OF HOUSE BILL 5352 AS INTRODUCED 10-29-01

The Natural Resources and Environmental Protection Act allows, among others, farming, horticulture, silviculture, lumbering, and ranching activities to take place in a wetland without a permit. The allowable practices include plowing; irrigation; irrigation ditching; seeding; cultivating; minor drainage; harvesting for the production of food, fiber, and forest products; and upland soil and water conservation practices. Under the bill, the allowable practices would include, but would not be limited to, the practices listed above. In addition, the bill would also allow activities reasonably necessary to commence and continue farming or to bring land into agricultural production.
