A SUMMARY OF HOUSE BILL 5478 AS INTRODUCED 11-29-01
Currently, Part 401 of the Natural Resources and Environmental Protection Act (NREPA), concerning wildlife conservation, specifies that only the legislature may designate a species as game (MCL.324.40110). House Bill 5478 would repeal this provision, and would specify, instead, that the Natural Resources Commission (NRC) would have exclusive authority to designate game (currently, the act specifies only that the NRC has authority to regulate the taking of game).
House Bill 5478 would also delete the list of animals currently designated as game under Part 401. Instead, "game" would refer to animals designated as game by the NRC. In addition, the bill would include a "registered Cervidae livestock facility" under the act. ("Cervidae species" is defined under the Privately Owned Cervidae Producers Marketing Act (MCL 287.952) to include deer, elk, moose, reindeer, and caribou; and "cervidae livestock facility" is defined under that act to mean a privately owned cervidae livestock operation on privately controlled lands capable of holding cervidae species.)
