A SUMMARY OF HOUSE BILL 5580 AS INTRODUCED 1-30-02

House Bill 5580 would amend the Michigan Vehicle Codeto require that the secretary of state develop and issue a "Spay and Neuter" fundraising license plate, having the vignette of a dog and a cat inscribed on it. Further, the bill would create a Spay and Neuter Fund within the Department of Treasury, to be disbursed by the Office of the Secretary of State. A person would pay an additional $25 for a Spay and Neuter fundraising license plate, and the donation would be deposited into the fund. (In addition to the donation, an applicant would pay the regular registration tax and a $5 service fee.)

House Bill 5580 specifies that the state treasurer could receive money or other assets from any source for deposit into the Spay and Neuter fund, and would direct investment of those funds, as well as credit to the fund the interest and earnings from fund investments. Money in the fund at the close of the fiscal year would not lapse to the general fund.

The bill also specifies that the secretary of state would be required to disburse money in the fund on a quarterly basis to the Michigan Humane Society to cover the cost of spaying and neutering dogs and cats under the society's care. An agency that received money would be required to provide an annual accounting of the use of the money to the county.
