A SUMMARY OF HOUSE BILL 5737 AS INTRODUCED 2-21-02

House Bill 5737 would amend the Freedom of Information Act (MCL 15.243) to allow a public body to generally exempt from disclosure as a public record records, recordings, and other reports of emergency telephone calls made to the 9-1-1 system, unless the public interest in disclosure outweighed the public interest in nondisclosure in a particular instance. If a public body generally exempted such disclosures, it would still have to disclose calls in the following circumstances:

·  calls to persons within the 9-1-1 system to the extent necessary to implement and manage the 9-1-1 system;

·  calls to a law enforcement officer or law enforcement agency for the purpose of criminal investigations related to a 9-1-1 call; and

·  in accordance with a court order.
