A SUMMARY OF HOUSE BILL 5858 AS INTRODUCED 4-9-02
When a criminal violation is specified in statute only as a misdemeanor or felony, but no maximum penalty is specified, the Michigan Penal Code provides that the maximum penalty for a felony is up to four years' imprisonment and/or a fine of up to $2,000; a misdemeanor is punishable by up to 90 days' imprisonment and/or a maximum fine of $100.
The bill would amend the penal code to increase the maximum fine in the penalty that applies to a felony or misdemeanor for which no other punishment is prescribed. For a felony, the bill would raise the maximum fine from $2,000 to $5,000. For a misdemeanor, the bill would raise the maximum fine from $100 to $500.
