DISPOSITION OF LOANED MILITARY EQUIPMENT

House Bill 5888

Sponsor: Rep. Larry Julian

Committee: Veterans Affairs

Complete to 5-14-02

A SUMMARY OF HOUSE BILL 5888 AS INTRODUCED 4-11-02

The bill would create a new act to provide for the disposition of demilitarized military equipment and artifacts. Specifically, the bill would require the recipient of such equipment from a federal agency to display the equipment in accordance with the agreement with the donor under the grant of conditional title. If the recipient no longer wished to keep the equipment, he or she would be required to return the equipment in a manner that complies with federal law. If the donor of the equipment could not be identified, the equipment would be disposed of in accordance with section 7545 of Title 10 of the United States Code. [Section 7545 allows the Secretary of the Navy to loan or give certain obsolete materials and other articles of historical interest that are not needed by the Department of the Navy to, among others, a state, a library, a state museum, and any recognized war veterans' association.]
