A SUMMARY OF HOUSE BILL 6153 AS INTRODUCED 5-30-02

Under the Public Health Code, nursing homes are subject to certain required staffing ratios. A nursing home must employ nursing personnel sufficient to provide continuous 24-hour nursing care and services sufficient to meet the needs of each patient in the nursing home. The code requires that a licensed nursing home maintain staff sufficient to provide not less than 2.25 hours of nursing care by employed nursing personnel per patient per day. The ratio of patients to nursing personnel cannot exceed 8:1 for a morning shift, 12:1 for an afternoon shift, and 15:1 for a nighttime shift. House Bill 6153 would amend the code to specify that in no case could an employee who is not designated as a member of the nursing staff be included in counting these minimum ratios of nursing personnel to patients.
