A SUMMARY OF HOUSE BILL 6199 AS INTRODUCED 6-13-02
Generally, under the Insurance Code, the commissioner of the Office of Financial or Insurance Services (OFIS) or his or her designee presides over administrative hearings. However, the code currently allows the subject of the hearing to request the commissioner designate an independent hearing officer selected from a list of qualified individuals that has been submitted by the American Arbitration Association. The person who is the subject of the hearing is allowed to exercise one peremptory dismissal of the independent hearing officer selected if he or she exercises that right within 20 days after notification of the officer selected. House Bill 6199 would amend the code to eliminate this provision. Therefore, only the commissioner or his or her designee could preside over administrative hearings.
