A SUMMARY OF HOUSE BILL 6243 AS INTRODUCED 7-3-02

Under the Public Health Code (Public Act 368 of 1975), the courts are permitted or required to order a variety of health tests on individuals who are arrested, charged, or bound over for trial. These health screenings including testing for venereal disease, hepatitis B, HIV, or AIDS. The bill would add that the court could, upon conviction, order an individual who is examined or tested to pay the actual and reasonable costs of the examination or test. In addition, the bill would require a person who is ordered to pay the costs of an examination or test to pay those costs within 30 days or as otherwise provided by the court. A person who fails to pay the costs as ordered would be guilty of a misdemeanor punishable by imprisonment not exceeding 90 days, a fine not exceeding $100, or both.
