A SUMMARY OF HOUSE BILL 6389 AS INTRODUCED 9-24-02
House Bill 6389 would amend Public Act 152 of 1929, which provides for a state-owned and operated radio broadcast system for police purposes, to require the state police to allow any governmental public safety agency to use the system and to attach public safety communications equipment to towers constructed under the act. Currently the act specifies that the director of the state police may authorize governmental public safety agencies to use the system, which is known as the Michigan public safety communications system. Under the bill, the director of the state police could deny permission to install local governmental public safety equipment or to attach such equipment to a tower if the installation or attachment would interfere with the "optimum operation" of the state public safety communications system, as determined by the system's advisory board and the Department of Management and Budget. All costs associated with installing and maintaining local governmental public safety agency equipment would be the responsibility of the local governmental public safety agency requesting permission to do so.
