A SUMMARY OF HOUSE JOINT RESOLUTION GG AS INTRODUCED 9-24-02

Article IV, Section 29 of the state constitution says that the legislature may not pass a local or special act in any case where a general act can be made applicable, and that whether a general act could be made applicable is a judicial question. A local or special act cannot take effect unless it is approved by a two thirds vote of each house of the legislature and also by a majority vote of the electors in the affected local unit. However, an act repealing local or special acts may be enacted upon a majority vote of each house, and does not require a local vote.

House Joint Resolution GG would amend this provision to specify that a bill providing for a local or special act could only be introduced in the legislature by a member who resides in the affected local unit.

The joint resolution would be submitted to the voters at the next general election.
