CONTENT


The bill would amend the Drain Code to allow any county board of commissioners by a majority vote to abolish the office of drain commissioner and transfer its powers and duties to the board of county road commissioners. Currently, the Code allows the abolishment and transfer of the office by a two-thirds vote, and only if the county has a population of less than 12,000.


The Code also provides that if a county has a department of public works or a public improvement agency (with the drain commissioner designated as the county agent), the county board of commissioners may, by a two-thirds vote, combine the duties of that department or agency with those of the office of drain commissioner into one county department headed by a public works commissioner. The bill would retain this authorization and the two-thirds requirement, but would strike language stating that the public works commissioner must carry out the powers and duties of the drain commissioner.
