CONSTRUCTION CODE APPEALS - H.B. 4771: COMMITTEE SUMMARY
House Bill 4771 (as passed by the House)
Sponsor: Representative Gene DeRossett
House Committee: Regulatory Reform
Senate Committee: Economic Development, International Trade and Regulatory Affairs
CONTENT
The bill would amend the Single State Construction Code Act to require that the executive director of the State Construction Code Commission refer to the appropriate board, an appeal to the Commission that related principally to a mechanical matter. (The Act defines "board" as the State plumbing board, the board of mechanical rules, the electrical administrative board, and the barrier-free design board.)
The Act allows an interested person, or an interested person's authorized agent, to appeal a decision of a local board of appeals to the State Construction Code Commission. Appeals may be heard by the Commission as a whole, or by a panel of three or more members designated by the chairperson of the Commission. The executive director, however, must refer an appeal to the appropriate board if, in his or her judgment, the appeal relates principally to a plumbing, electrical, or barrier-free design matter. The bill would add a mechanical matter to that provision.
