AUTO POLICY FILING FEE - H.B. 4784: COMMITTEE SUMMARY

House Bill 4784 (as passed by the House)

Sponsor: Representative Alan Sanborn

House Committee: Insurance and Financial Services

Senate Committee: Financial Services

Date Completed: 10-2-01

CONTENT

The bill would amend the Insurance Code by eliminating a filing fee necessary to contest an automobile policy cancellation. Under current law, an insured must supply the Department of Consumer and Industry Services with a written request and a $15 fee to contest the grounds of a cancellation. The bill would eliminate the fee and require the request to be filed with the Commissioner of the Office of Financial and Insurance Services. The Code states that the request must be filed within seven days after notice of the cancellation is mailed; the bill would retain that requirement.
