COURT RECORDS: DHAL - H.B. 4954 (H-1): FLOOR ANALYSIS

House Bill 4954 (Substitute H-1 as reported with amendment)

Sponsor: Representative Bill McConico

House Committee: Commerce

Senate Committee: Government Operations

CONTENT

The bill would amend the Revised Judicature Act to refer to the Department of History, Arts, and Libraries (DHAL), instead of the Department of State, in provisions involving the retention of court records.

Currently, if a public officer reproduces court records kept by him or her pursuant to the Records Media Act, the officer may offer the original records to the Department of State for placement in the State archives. If the Department accepts the offer within 30 days, the court must transfer the records to the Department. The bill would refer to the DHAL, instead of the Department of State.

The bill would take effect August 6, 2001, and is tie-barred to House Bill 4941, which would create the DHAL.
