VEHICLE BODY SHOP INSPECTIONS - H.B. 5361: COMMITTEE SUMMARY
House Bill 5361 (as passed by the House)
Sponsor: Representative David Woodward
House Committee: Commerce
Senate Committee: Transportation and Tourism
Date Completed: 5-21-02
CONTENT
The bill would amend the Motor Vehicle Service and Repair Act to eliminate a requirement that, at least once every four years, the Secretary of State (or his or her designee) inspect a motor vehicle repair facility that performs vehicle body work.
The Act requires that all auto repair shops be registered with the Secretary of State. At least once every four years, the Secretary of State must inspect the premises and parts inventories of facilities that engage in vehicle body work. The bill would eliminate this inspection requirement. The Act also permits the Secretary of State and other law enforcement officials to make periodic, unannounced inspections of the premises and parts inventories of facilities. The bill would retain this provision, and add "parts records" to the items subject to inspection.

FISCAL IMPACT
The bill would require fewer inspections of the premises and records of auto repair facilities. The Department of State reports that the Department resources in the Bureau of Automotive Regulation that are currently being used for this purpose would be redirected to targeting unlicensed facilities, resulting in no net impact on the State.
