HOUSE BILL No. 4155 February 7, 2001, Introduced by Reps. Howell, Meyer, Kolb, Gilbert, Hager, Anderson, Newell, Koetje, Kuipers, Van Woerkom, Cassis, Ehardt, DeRossett, Pappageorge, Sanborn, Kooiman and Jelinek and referred to the Committee on Education. A bill to amend 1979 PA 94, entitled "The state school aid act of 1979," by amending section 96 (MCL 388.1696), as added by 2000 PA 297. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 96. (1) From the state school aid fund money appropri- 2 ated in section 11, there is allocated an amount not to exceed 3 $8,000,000.00 each fiscal year for 1999-2000, for 2000-2001, for 4 2001-2002, and for 2002-2003 for golden apple awards under this 5 section. The awards shall be based on elementary school achieve- 6 ment on the fourth grade and fifth grade Michigan education 7 assessment program (MEAP) tests. 8 (2) To be eligible for a golden apple award, an elementary 9 school THAT OPERATES BOTH OF GRADES 4 AND 5 shall have at least 10 50 pupils in membership and shall meet the following 11 requirements: 02094'01 TAV 2 1 (a) For 1999-2000, at least 80% of the fourth and fifth 2 grade pupils enrolled and in regular daily attendance in the 3 school on the pupil membership count day in that school year took 4 the applicable MEAP tests, and 1 or both of the following are 5 met: 6 (i) The composite score for the pupils in the school who 7 took the applicable MEAP tests increased by at least 60 points 8 over the 2 consecutive school years immediately preceding the 9 state fiscal year in which the award is given. 10 (ii) The test scores for the pupils in the school who took 11 the applicable MEAP tests are among the highest elementary school 12 scores statewide, as determined by the department of treasury, 13 for that school year. 14 (b) Beginning in 2000-2001, at least 90% of the fourth and 15 fifth grade pupils enrolled and in regular daily attendance in 16 the school on the pupil membership count day in that school year 17 took the applicable MEAP tests, and 1 or both of the following 18 are met: 19 (i) The composite score for the pupils in the school who 20 took the applicable MEAP tests increased by at least 60 points 21 over the 2 consecutive school years immediately preceding the 22 state fiscal year in which the award is given. 23 (ii) The test scores for the pupils in the school who took 24 the applicable MEAP tests are among the highest elementary school 25 scores statewide, as determined by the department of treasury, 26 for that school year. 02094'01 3 1 (3) TO BE ELIGIBLE FOR A GOLDEN APPLE AWARD, AN ELEMENTARY 2 SCHOOL THAT OPERATED ONLY 1 OF GRADES 4 AND 5 IN 1999-2000 AND 3 THAT OPERATES ONLY 1 OF THOSE GRADES IN THE FISCAL YEAR OF THE 4 AWARD SHALL HAVE AT LEAST 50 PUPILS IN MEMBERSHIP AND SHALL MEET 5 THE FOLLOWING REQUIREMENTS: 6 (A) FOR 1999-2000, AT LEAST 80% OF THE FOURTH OR FIFTH GRADE 7 PUPILS, AS APPLICABLE, ENROLLED AND IN REGULAR DAILY ATTENDANCE 8 IN THE SCHOOL ON THE PUPIL MEMBERSHIP COUNT DAY IN THAT SCHOOL 9 YEAR TOOK THE MEAP TESTS FOR THAT GRADE, AND 1 OR BOTH OF THE 10 FOLLOWING ARE MET: 11 (i) THE COMPOSITE SCORE FOR THE PUPILS IN THE SCHOOL WHO 12 TOOK THE APPLICABLE MEAP TESTS INCREASED BY AT LEAST 60 POINTS 13 OVER THE 2 CONSECUTIVE SCHOOL YEARS IMMEDIATELY PRECEDING THE 14 STATE FISCAL YEAR IN WHICH THE AWARD IS GIVEN. 15 (ii) THE TEST SCORES FOR THE PUPILS IN THE SCHOOL WHO TOOK 16 THE APPLICABLE MEAP TESTS ARE AMONG THE HIGHEST ELEMENTARY SCHOOL 17 SCORES STATEWIDE FOR THAT GRADE, AS DETERMINED BY THE DEPARTMENT 18 OF TREASURY, FOR THAT SCHOOL YEAR. 19 (B) BEGINNING IN 2000-2001, AT LEAST 90% OF THE FOURTH OR 20 FIFTH GRADE PUPILS, AS APPLICABLE, ENROLLED AND IN REGULAR DAILY 21 ATTENDANCE IN THE SCHOOL ON THE PUPIL MEMBERSHIP COUNT DAY IN 22 THAT SCHOOL YEAR TOOK THE MEAP TESTS FOR THAT GRADE, AND 1 OR 23 BOTH OF THE FOLLOWING ARE MET: 24 (i) THE COMPOSITE SCORE FOR THE PUPILS IN THE SCHOOL WHO 25 TOOK THE APPLICABLE MEAP TESTS INCREASED BY AT LEAST 60 POINTS 26 OVER THE 2 CONSECUTIVE SCHOOL YEARS IMMEDIATELY PRECEDING THE 27 STATE FISCAL YEAR IN WHICH THE AWARD IS GIVEN. 02094'01 4 1 (ii) THE TEST SCORES FOR THE PUPILS IN THE SCHOOL WHO TOOK 2 THE APPLICABLE MEAP TESTS ARE AMONG THE HIGHEST ELEMENTARY SCHOOL 3 SCORES STATEWIDE FOR THAT GRADE, AS DETERMINED BY THE DEPARTMENT 4 OF TREASURY, FOR THAT SCHOOL YEAR. 5 (4)(3)A golden apple award under this section shall be 6 allocated to and used by a district exclusively for the purpose 7 of distributing funds to each eligible elementary school. A 8 golden apple award shall consist of $1,000.00 per each full-time 9 employee who works in the eligible elementary school plus 10 $10,000.00 to be allocated to the principal of the school for 11 school improvements, but shall not be less than $50,000.00 per 12 recipient school. All money allocated under this section per 13 full-time employee shall be used for school improvements, as 14 determined collectively by a majority vote of those employees. 15 (5)(4)Funds allocated under this section that are not 16 expended in the state fiscal year for which they were allocated 17 may be carried forward to a subsequent state fiscal year. 18 (6) IF THE DEPARTMENT DETERMINES THAT THE AMOUNT ALLOCATED 19 UNDER THIS SECTION FOR A PARTICULAR FISCAL YEAR IS NOT SUFFICIENT 20 TO FULLY FUND AWARDS TO ALL ELIGIBLE ELEMENTARY SCHOOLS FOR THAT 21 FISCAL YEAR, THE DEPARTMENT SHALL PRORATE THE AMOUNT OF THE 22 AWARDS FOR THAT FISCAL YEAR ACCORDINGLY. 02094'01 Final page.
