A bill to prohibit certain political subdivisions of this state from initiating or participating in certain civil actions. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Person" means an individual, partnership, corporation, 3 association, or other legal entity. 4 (b) "Political subdivision" means a county, city, township, 5 or village. 6 (c) "Production" means manufacture, construction, design, 7 formulation, development of standards, preparation, processing, 8 assembly, inspection, testing, listing, certifying, warning, 9 instructing, marketing, selling, advertising, packaging, or 10 labeling. 11 Sec. 2. (1) Except as otherwise provided in this section, a 12 political subdivision of this state shall not file, prosecute, or 00223'01 KDD 2 1 join, on its own behalf or on behalf of its citizens or another 2 class of persons, a civil action for damages or other remedy 3 against a person for the production of a legal product. 4 (2) This section does not apply to an action related to a 5 product purchased and used by the political subdivision that is 6 based on a breach of contract or warranty. 00223'01 Final page.
