        A bill to amend 1976 PA 451, entitled

   "The revised school code,"

   by amending section 1289 (MCL 380.1289), as amended by 1995

   PA 289.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 1289.  (1) Female pupils shall be permitted to compete

 2
      for a position in all interscholastic athletic activities.  If a

 3
      school has a girls' team in an interscholastic athletic activity,

 4
      a female shall be permitted to compete for a position on any

 5
      other team for that activity.  This subsection shall not be con-

 6
      strued to prevent or interfere with the selection of competing

 7
      teams solely on the basis of athletic ability.

           (2) IF A PUBLIC SCHOOL HAS BOTH A MALE AND FEMALE

 9
      INTERSCHOLASTIC ATHLETIC TEAM IN THE SAME SPORT AT THE HIGH

      SCHOOL LEVEL, THE GOVERNING BOARD OF THE PUBLIC SCHOOL SHALL

      ENSURE THAT THE SEASONS FOR BOTH TEAMS COINCIDE.
