A bill to amend 1979 PA 94, entitled "The state school aid act of 1979," by amending section 166b (MCL 388.1766b), as amended by 1999 PA 119. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 166b. (1) This act does not prohibit a parent or legal 2 guardian of a minor who is enrolled in any of grades 1 to 12 in a 3 nonpublic school or who is being home-schooled from also enroll- 4 ing the minor in a district or intermediate district in any cur- 5 ricular offering that is provided by the district or intermediate 6 district at a public school site and is available to pupils in 7 the minor's grade level or age group, subject to compliance with 8 the same requirements that apply to a full-time pupil's 9 participation in the offering. However, state school aid shall 10 be provided under this act for a minor enrolled as described in 00383'01 TAV 2 1 this subsection only for curricular offerings that are offered to 2 full-time pupils in the minor's grade level or age group during 3 regularly scheduled school hours. 4 (2) This act does not prohibit a parent or legal guardian of 5 a minor who is enrolled in any of grades 1 to 12 in a nonpublic 6 school located within the district or who resides within the dis- 7 trict and is being home-schooled from also enrolling the minor in 8 the district in a curricular offering being provided by the dis- 9 trict at the nonpublic school site. However, state school aid 10 shall be provided under this act for a minor enrolled as 11 described in this subsection only if all of the following apply: 12(a) The nonpublic school site is located, or the nonpublic13students are educated, within the geographic boundaries of either14the district or a contiguous district operating under a coopera-15tive program of which the district is a member and that is estab-16lished for the purpose of providing nonessential elective courses17to nonpublic school students.18 (A)(b)The nonpublic school is registered with the 19 department as a nonpublic school and meets all state reporting 20 requirements for nonpublic schools. 21 (B)(c)The instruction is scheduled to occur during the 22 regular school day. 23 (C)(d)The instruction is provided directly by an 24 employee of the district or of an intermediate district. 25 (D)(e)The curricular offering is also available to 26 full-time pupils in the minor's grade level or age group in the 27 district during the regular school day at a public school site. 00383'01 3 1(f) The curricular offering is restricted to nonessential2elective courses for pupils in grades 1 to 12.3 (3) A minor enrolled as described in this section is a 4 part-time pupil for purposes of state school aid under this act. 00383'01 Final page.
