        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 82118 (MCL 324.82118), as amended by 1996 PA

   183.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 82118.  (1) In addition to registration of a snowmobile

 2
      pursuant to section 82105 or registration in another state or

 3
      province, beginning October 1, 1994, except as otherwise provided

 4
      in this section, a person who desires to operate a snowmobile in

 5
      this state shall purchase a Michigan snowmobile trail permit

 6
      sticker.  The Michigan snowmobile trail permit issued under this

 7
      section shall be valid for a period of 1 year which begins on

 8
      October 1 and ends on the following September 30.  The fee for

 9
      the permit  is $10.00.  Fifty cents of the fee shall be retained

      by the department for administrative costs.  Fifty cents of the

      fee shall be retained by the agent selling the permit.  Nine

 2
      dollars of the fee shall be credited to the recreational snowmo-

 3
      bile trail improvement fund created in section 82110.  SHALL BE

 4
      THE FOLLOWING AMOUNT FOR THE PERIODS INDICATED:

 5
           (A) $10.00 UNTIL OCTOBER 1, 2001.

           (B) $20.00 BEGINNING OCTOBER 1, 2001 THROUGH SEPTEMBER 30,

 7
      2004.

           (C) $25.00 BEGINNING OCTOBER 1, 2004.

           (2) REVENUE FROM THE TRAIL PERMIT FEE SHALL BE ALLOCATED AS

      FOLLOWS:

           (A) UNTIL OCTOBER 1, 2001:

           (i) $9.00 TO THE RECREATIONAL SNOWMOBILE TRAIL IMPROVEMENT

      FUND.

           (ii) 50 CENTS SHALL BE RETAINED BY THE DEPARTMENT FOR ADMIN-

      ISTRATIVE COSTS.

           (iii) 50 CENTS SHALL BE RETAINED BY THE AGENT SELLING THE

17
      PERMIT.

           (B) BEGINNING OCTOBER 1, 2001 THROUGH SEPTEMBER 30, 2004:

           (i) $18.50 TO THE RECREATIONAL SNOWMOBILE TRAIL IMPROVEMENT

      FUND.

           (ii) 50 CENTS SHALL BE RETAINED BY THE DEPARTMENT FOR ADMIN-

      ISTRATIVE COSTS.

           (iii) $1.00 SHALL BE RETAINED BY THE AGENT SELLING THE

           (i) $23.50 TO THE RECREATIONAL SNOWMOBILE TRAIL IMPROVEMENT

           (iii) $1.00 SHALL BE RETAINED BY THE AGENT SELLING THE

      PERMIT.

           (3)  (2)  The trail permit sticker shall be permanently

 6
      affixed to the forward half of the snowmobile directly above or

 7
      below the headlight of the snowmobile.

 8
           (4)  (3)  The department may contract with a person to act

 9
      as an agent for the purpose of issuing Michigan snowmobile trail

10
      permits.  The department shall sell the permits to agents in

11
      bulk.  Agents may obtain a refund from the department for any

12
      permits that are not sold.

           (5)  (4)  An agent who uses or allows the use of a permit by

14
      anyone except the snowmobile user to whom the permit is sold is

15
      guilty of a misdemeanor, punishable by a fine of $50.00 for each

16
      instance of such use or allowed use.

           (6)  (5)  The department of state may suspend a certificate

18
      of registration when the department of state determines that the

19
      required fee has not been paid and remains unpaid after reason-

20
      able notice or demand.  In addition to the required fee, a $10.00

21
      penalty shall be assessed and collected against any person who

22
      tenders an insufficient check or draft in payment of the fee.

           (7)  (6)  A snowmobile used solely for transportation on the

24
      frozen surface of public waters for the purpose of ice fishing is

25
      exempt from the requirement of purchasing and displaying a snow-

26
      mobile trail permit sticker under this section.

           (8)  (7)  A person shall not charge a fee for a snowmobile

 2
      trail permit in an amount that is greater than the fee printed on

 3
      the face of the permit.

 4
           (9)  (8)  To obtain a snowmobile trail permit, an applicant

 5
      must provide all information required on the permit application.

 6
           (10)  (9)  A person who fails to secure a permit under this

 7
      section or who violates subsection (2) is responsible for a state

 8
      civil infraction and may be ordered to pay a civil fine of not

 9
      more than $50.00.
