Richner, Jansen, Birkholz and Lemmons and referred to the Committee on Commerce.


        A bill to amend 1992 PA 147, entitled

   "Neighborhood enterprise zone act,"

   by amending section 10 (MCL 207.780).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 10.  (1) The effective date of the neighborhood enter-

 2
      prise zone certificate is the  first day of  DECEMBER 31 IN THE

 3
      YEAR IMMEDIATELY PRECEDING the tax year  following the year  in

 4
      which the new facility or rehabilitated facility is substantially

 5
      completed and, for a new facility, occupied by an owner as a

 6
      principal residence, as evidenced by the owner filing with the

 7
      assessor of the local assessing unit all of the following:

 8
           (a) For a new facility, a certificate of occupancy.

 9
           (b) For a rehabilitated facility, a certificate that the

10
      improvements meet minimum local building code standards issued by

11
      the local building inspector or other authorized officer or a

      certificate of occupancy if required by local building permits or

 2
      building codes.

           (c) For a rehabilitated facility, documentation proving the

 4
      cost requirements of section 2(h) are met.

 5
           (d) For a new facility, an affidavit executed by an owner

 6
      affirming that the new facility is occupied by an owner as a

 7
      principal residence.

           (2) The owner, or any subsequent owner, of a new facility

 9
      before November 1 of each year the certificate is in force shall

10
      submit to the assessor of the local assessing unit an affidavit

11
      executed by the owner affirming that the new facility is occupied

12
      by the owner as a principal residence.
