A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961," by amending sections 8121, 8123, and 8130 (MCL 600.8121, 600.8123, and 600.8130), section 8121 as amended by 2000 PA 449, section 8123 as amended by 2000 PA 448, and section 8130 as amended by 1988 PA 135. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 8121. (1) The sixteenth district consists of the city 2 of Livonia, is a district of the third class, and has 2 judges. 3 (2) The seventeenth district consists of the township of 4 Redford in the county of Wayne, is a district of the third class, 5 and has 2 judges. 6 (3)TheEXCEPT AS OTHERWISE PROVIDED IN THIS SUBSECTION, 7 THE eighteenth district consists of the city of Westland, is a 8 district of the third class, and has 2 judges. IF THE GOVERNING 01357'01 * DRM 2 1 BODY OF THE CITY OF WESTLAND APPROVES THE REORGANIZATION OF THE 2 EIGHTEENTH DISTRICT BY RESOLUTION ADOPTED AND FILED WITH THE 3 STATE COURT ADMINISTRATOR NOT LATER THAN SEPTEMBER 1, 2001, AND 4 IF THE GOVERNING BODY OF THE CITY OF WAYNE APPROVES THE ABOLITION 5 OF THE TWENTY-NINTH DISTRICT PURSUANT TO SUBSECTION (14), THE 6 EIGHTEENTH DISTRICT CONSISTS OF THE CITIES OF WESTLAND AND WAYNE, 7 IS A DISTRICT OF THE THIRD CLASS, AND HAS 3 JUDGES EFFECTIVE 8 JANUARY 1, 2002. 9 (4) The nineteenth district consists of the city of 10 Dearborn, is a district of the third class, and has 3 judges. 11 (5) The twentieth district consists of the city of Dearborn 12 Heights, is a district of the third class, and has 2 judges. 13 (6) The twenty-first district consists of the city of Garden 14 City, is a district of the third class, and has 1 judge. 15 (7) The twenty-second district consists of the city of 16 Inkster, is a district of the third class, and has 1 judge. 17 (8) The twenty-third district consists of the city of 18 Taylor, is a district of the third class, and has 2 judges. 19 (9) The twenty-fourth district consists of the cities of 20 Allen Park and Melvindale, is a district of the third class, and 21 has 2 judges. 22 (10) The twenty-fifth district consists of the city of 23 Lincoln Park, is a district of the third class, and has 2 24 judges. 25 (11) The twenty-sixth district consists of the cities of 26 River Rouge and Ecorse, is a district of the third class, and is 27 divided into the following election divisions: 01357'01 * 3 1 (a) The first division consists of the city of River Rouge 2 and has 1 judge. 3 (b) The second division consists of the city of Ecorse and 4 has 1 judge. 5 (12) The twenty-seventh district consists of the following, 6 as applicable: 7 (a) Until January 1, 2003 or until a vacancy occurs in a 8 judgeship in the twenty-seventh district, whichever occurs first, 9 the twenty-seventh district consists of the cities of Wyandotte 10 and Riverview, is a district of the third class, and is divided 11 into the following election divisions: 12 (i) The first division consists of the city of Wyandotte and 13 has 1 judge. 14 (ii) The second division consists of the city of Riverview 15 and has 1 judge. 16 (b) Beginning January 1, 2003 or the date on which a vacancy 17 occurs in a judgeship in the twenty-seventh district, whichever 18 occurs first, the twenty-seventh district consists of the cities 19 of Wyandotte and Riverview, is a district of the third class, and 20 has 1 judge. The remaining incumbent judge of the twenty-seventh 21 district shall serve as the judge of the entire twenty-seventh 22 district for the balance of the term to which he or she was 23 elected or appointed. 24 (13) The twenty-eighth district consists of the city of 25 Southgate, is a district of the third class, and has 1 judge. 26 (14)TheEXCEPT AS OTHERWISE PROVIDED IN THIS SUBSECTION, 27 THE twenty-ninth district consists of the city of Wayne, is a 01357'01 * 4 1 district of the third class, and has 1 judge. IF THE GOVERNING BODY OF THE CITY OF BERKLEY 13 APPROVES THE REORGANIZATION OF THE FORTY-FIFTH-A DISTRICT PURSU- 14 ANT TO SUBSECTION (3) AND THE GOVERNING BODIES OF THE CITIES OF 15 HUNTINGTON WOODS, OAK PARK, AND PLEASANT RIDGE AND THE TOWNSHIP 16 OF ROYAL OAK APPROVE THE ABOLITION OF THE FORTY-FIFTH-B DISTRICT 17 BY RESOLUTION ADOPTED AND FILED WITH THE STATE COURT ADMINISTRA- 18 TOR NOT LATER THAN SEPTEMBER 1, 2001, THE FORTY-FIFTH-B DISTRICT 19 IS ABOLISHED EFFECTIVE JANUARY 1, 2003. 20 (5) The forty-sixth district consists of the cities of 21 Southfield and Lathrup Village and the township of Southfield in 22 the county of Oakland, is a district of the third class, and has 23 3 judges. 24 (6) The forty-seventh district consists of the cities of 25 Farmington and Farmington Hills, is a district of the third 26 class, and has 2 judges. Subject to section 8175, this district 27 may have 1 additional judge subject to review and recommendation 01357'01 * 7 1 by the state court administrator to the legislature and 2 subsequent legislation, if and when a district court judgeship is 3 eliminated within the state of Michigan. 4 (7) The forty-eighth district consists of the cities of 5 Birmingham, Bloomfield Hills, Sylvan Lake, Keego Harbor, and 6 Orchard Lake Village and the townships of Bloomfield and West 7 Bloomfield in the county of Oakland, is a district of the third 8 class, and has 3 judges. 9 (8) The fiftieth district consists of the city of Pontiac, 10 is a district of the third class, and HAS THE FOLLOWING NUMBER OF 11 JUDGES: 12 (A) UNTIL 12 NOON, JANUARY 1, 2003, THIS DISTRICT has 4 13 judges. 14 (B) BEGINNING 12 NOON, JANUARY 1, 2003, THIS DISTRICT HAS 3 15 JUDGES. 16 (9) The fifty-first district consists of the township of 17 Waterford in the county of Oakland, is a district of the third 18 class, and has 2 judges. 19 (10) The fifty-second district consists of the county of 20 Oakland except the cities of Madison Heights, Ferndale, Hazel 21 Park, Royal Oak, Berkley, Huntington Woods, Oak Park, Pleasant 22 Ridge, Southfield, Lathrup Village, Farmington, Farmington Hills, 23 Northville, Sylvan Lake, Keego Harbor, Orchard Lake Village, 24 Birmingham, Bloomfield Hills, and Pontiac and the townships of 25 Royal Oak, Southfield, West Bloomfield, Bloomfield, and 26 Waterford, is a district of the second class, and is divided into 27 the following election divisions: 01357'01 * 8 1 (a) The first division consists of the cities of Novi, South 2 Lyon, Wixom, and Walled Lake and the townships of Milford, 3 Highland, Commerce, Lyon, and Novi. Until January 1, 2003, the 4 first division also includes the townships of Rose and White 5 Lake. The first division has 3 judges. Subject to section 8175, 6 this division may have 1 additional judge effective January 1, 7 2003. If the Oakland county board of commissioners approves that 8 additional judgeship, the judgeship in the first division that is 9 filled by the district judge of the first division whose term 10 expires January 1, 2005 is transferred to the second division, 11 effective January 1, 2003. 12 (b) The second division consists of the city of the village 13 of Clarkston and the townships of Springfield, Independence, 14 Holly, Groveland, and Brandon. Beginning January 1, 2003, the 15 second division also includes the townships of Rose and White 16 Lake. The second division has 1 judge; however, effective 17 January 1, 2003, this division shall have 2 judges if a judgeship 18 is transferred to this division from the first division pursuant 19 to subdivision (a). 20 (c) The third division consists of the cities of Rochester, 21 Auburn Hills, Rochester Hills, and Lake Angelus and the townships 22 of Oxford, Addison, Orion, and Oakland and has 3 judges. 23 (d) The fourth division consists of the cities of Troy and 24 Clawson and has 3 judges. 25 Sec. 8130. (1) The sixty-first district consists of the 26 city of Grand Rapids, is a district of the third class and has 01357'01 * 9 156 judges.Subject to section 8175, this district may have 12additional judge effective January 1, 1989.3 (2) The sixty-second-a district consists of the city of 4 Wyoming, is a district of the third class and has 2 judges. 5 (3) The sixty-second-b district consists of the city of 6 Kentwood, is a district of the third class and has 1 judge. 7 (4) The sixty-third district consists of the county of Kent 8 except the cities of Grand Rapids, Walker, Grandville, Wyoming 9 and Kentwood, is a district of the second class and is divided 10 into the following election divisions: 11 (a) The first division consists of the cities of Cedar 12 Springs and Rockford and the townships of Tyrone, Solon, Nelson, 13 Spencer, Sparta, Algoma, Courtland, Oakfield, Alpine, Plainfield, 14 Cannon and Grattan and has 1 judge. SUBJECT TO SECTION 8175, 15 THIS ELECTION DIVISION MAY HAVE 1 ADDITIONAL JUDGE EFFECTIVE 16 JANUARY 1, 2003. IF A NEW OFFICE OF JUDGE IS ADDED TO THIS DIS- 17 TRICT TO BE FILLED BY ELECTION IN 2002, THE TERM OF OFFICE OF THE 18 JUDGE FOR THAT ELECTION ONLY SHALL BE 4 YEARS. 19 (b) The second division consists of the cities of East Grand 20 Rapids and Lowell and the townships of Grand Rapids, Ada, 21 Vergennes, Cascade, Lowell, Byron, Gaines, Caledonia and Bowne 22 and has 1 judge. 23 Enacting section 1.
